The fifth and final level of appeal is a judicial review before the U.S. District Court. Instructions on how to request the appeal is included in the Department of Appeals Board (DAB) decision notice. The denied amount in controversy for requests made in 2008 must be at least $1,180. The appeal must be submitted in writing within 60 days after the date of the DABs decision notice.
